O novo procedimento para contratações diretas previsto pela IN nº 67/2021.
O Decreto 10.024/19 dispõe o formato obrigatório de “dispensa eletrônica” para contratação direta no âmbito da Administração Pública Federal, onde o cadastro da proposta e disputa deverão ocorrer por plataforma digital.
Segundo a Instrução Normativa n. 67/2021, o prazo fixado entre a divulgação do aviso de contratação direta e a efetiva abertura do procedimento não poderá ser inferior a 3 (três) dias úteis, tempo em que as empresas interessadas poderão se preparar para ofertar seus melhores preços.
Dentre as novidades, temos a possibilidade de etapa de lances, basicamente similar ao pregão eletrônico, onde a partir da data e horário estabelecidos para recebimento das propostas, o procedimento será aberto pelo sistema para envio de lances públicos e sucessivos por períodos não inferior a 6 (seis) horas ou superior a 10 (dez) horas.
Observação importante: A IN regula a dispensa eletrônica no âmbito da Administração Federal, no entanto, os órgãos e entidades da Administração Pública estadual, distrital ou municipal, direta ou indireta, quando executarem recursos da União decorrentes de transferências voluntárias, deverão observar as regras nela estabelecidas.
